Your use of the Platform signifies your complete and unconditional acceptance of these Terms, alongside our Privacy Policy. This applies to all users, whether you are seeking employment ("Candidates") or looking to hire ("Employers"). By registering or otherwise using the Platform, you expressly confirm your agreement with these outlined provisions. If you do not agree with any part of these Terms, you must refrain from using the Platform.

2. Purpose of the Platform

Hostique Jobs operates as a specialized service designed to streamline the recruitment process within the hospitality and restaurant industry. Our primary objective is to efficiently connect Employers with suitable Candidates.

  • For Employers: You can post detailed job openings and manage your hiring process.
  • For Candidates: You can explore job opportunities, submit applications, and manage your professional profile. Our Platform utilizes a digital matching system to facilitate effective connections.

3. Use of the Platform

Access to and use of the Hostique Jobs Platform is subject to the following conditions:

3.1. Registration and Account Integrity

To utilize the Platform's services, all users are required to create a personal account. You warrant that all information provided during registration, and throughout your use of the Platform, is accurate, complete, and current. You are obligated to promptly update your account details to ensure their continued veracity.

3.2. User Responsibility

You are solely responsible for safeguarding the confidentiality of your account credentials, including your username and password. Hostique Jobs shall not be held liable for any losses or damages arising from unauthorized access or use of your account.

3.3. Content and Intellectual Property

Users bear full responsibility for all content they submit, upload, or post on the Platform, and must ensure that such content does not infringe upon the intellectual property or other rights of any third party. All proprietary content and materials displayed on or comprising the Platform, including but not limited to software, designs, text, graphics, and trademarks, are the exclusive property of Hostique Jobs or its licensors.

4. Conditions for Candidates

Users seeking employment opportunities on the Platform are designated as Candidates.

4.1. Storage and Processing of Profile Information

The Platform securely stores all information provided in Candidates' profiles and uploaded resumes within our database. This data is processed using our technology to structure the information for optimal recruitment matching. Stored data may include, but is not limited to, full name, contact details (email, phone, address), photo, educational background, professional experience, skills, and certifications. By using the Platform, Candidates explicitly consent to the collection and use of this data to enhance the efficiency of the recruitment process.

4.2. Expressing Interest and Applying

Candidates can view job postings from Employers and submit applications or express interest in positions they wish to pursue. This functionality is designed to enable a more targeted and accelerated recruitment process.

4.3. Protection of Personal Data

The personal data of Candidates is handled and stored in strict adherence to our comprehensive Privacy Policy, which is fully compliant with the General Data Protection Regulation (GDPR).

5. Conditions for Employers

Users seeking to hire personnel through the Platform are designated as Employers.

5.1. Job Postings and Profile Matching

Employers must provide complete and accurate details for their job postings, including desired position, required experience, skills, and other relevant criteria. Hostique Jobs uses this detailed information to facilitate connections with the most suitable Candidates. Employers are solely responsible for the content and accuracy of their job listings and must comply with all applicable labor laws, including those prohibiting discrimination based on any protected status.

5.2. Communication with Candidates

Employers can communicate with Candidates through the Platform. All communications must be truthful, accurate, and in full compliance with applicable laws and professional standards. Employers agree not to disclose Candidates' personal information obtained via the Platform to third parties without the Candidate's explicit consent.

5.3. Payment Structure for Employers

Access to the Platform and job applications are free for Candidates. Employers are charged on a pay-per-hire basis, in accordance with pre- agreed commercial terms. All stated prices include VAT, where applicable. Invoices are automatically generated based on the billing details provided by the Employer upon registration. Payments are processed in accordance with the terms outlined during the agreement.

6. Responsibilities and Disclaimers

Hostique Jobs acts exclusively as a technological intermediary. We do not:

  • Guarantee that job offers will result in employment or that Employers will find a suitable Candidate.

  • Validate the accuracy or truthfulness of information provided by third parties (Candidates or Employers).

  • Participate in hiring decisions, mediate employment negotiations, or intervene in contractual terms, salaries, or work conditions.

  • Conduct criminal background checks on Candidates. This responsibility remains solely with the Employers.

  • Assume liability for any issues related to recruitment or hiring processes, including instances of fraud or malpractice by any user. While we strive to maintain the security, availability, and functionality of the Platform, we cannot guarantee uninterrupted service or complete freedom from bugs, technical issues, or cyberattacks.

7. Data Protection and GDPR Compliance

Hostique Jobs processes all personal data in full compliance with the General Data Protection Regulation (GDPR) and other relevant data protection laws, ensuring the security and privacy of our users' data. Users have the following rights concerning their personal data:

  • Access and Correction: You may request access to and correction of your personal data held by us at any time.
  • Data Deletion: You may request the deletion of your account and associated personal data by contacting our customer support team.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with the laws of Portugal. Any dispute or claim arising out of or in connection with the use of the Platform will be exclusively resolved by the competent courts located in Lisbon, Portugal. The parties hereby agree to waive any other jurisdiction they may be entitled to and submit to the exclusive jurisdiction of the Portuguese courts.
